2. Our services

SimplyIT provides website design and development, e-commerce, AI assistants (SAM), search engine optimisation (SEO), social media marketing, digital marketing campaigns, multilingual translation, software development (SaaS), web and email hosting, domain management, and related services. Specific services and deliverables are agreed in a separate quote, proposal or agreement.

3. Use of the website

You agree to use our website only for lawful purposes and not to:

  • Attempt to gain unauthorised access to any part of the site, server or network.
  • Interfere with, disrupt, or place undue load on the website.
  • Use the site to transmit malicious code, spam, or unlawful content.
  • Reproduce, copy, or commercially exploit our content without written permission.
  • Impersonate any person or entity, or misrepresent your identity.

We reserve the right to suspend access to the website for any breach of these Terms.

4. Intellectual property

All content on this site (text, graphics, logos, layouts, images, software and code) is owned by SimplyIT or our licensors and is protected by copyright, trademark and other laws. You may not reproduce or use our materials without prior written consent, except for personal, non-commercial viewing.

Where you provide content, materials or assets to us for a project, you grant us a licence to use those materials to deliver the agreed services. You are responsible for ensuring you have the rights to any content you supply.

5. Quotations, orders and payment

  • Prices are shown in US Dollars (USD) unless stated otherwise and may change at any time. Quotations are valid for the period stated in the quote.
  • Services are subject to a written quote or proposal agreed between us. A deposit may be required before work begins.
  • Unless agreed otherwise, invoices are payable within the terms stated on the invoice. Late payment may pause or suspend work.
  • Domain registration, hosting and third-party fees (e.g. payment processors, hosting) are billed at cost and may change.

6. Client responsibilities

To deliver your project, you agree to provide accurate information, brand assets and content in a timely manner, and to review and approve milestones and drafts. We are not responsible for delays caused by late or missing content, approvals or third-party services.

7. AI Assistants (SAM)

Our SAM AI assistants are provided to enhance customer experience and answer common questions. They operate using artificial intelligence and may:

  • Produce responses that are not always accurate, complete or appropriate.
  • Make bookings, trip plans, or enquiries based on the information you provide.

You are responsible for verifying any information you rely on from the assistant before making decisions or purchases. The assistant does not constitute professional, legal or financial advice.

8. Hosting and domain services

  • Hosting and domain services are provided subject to the terms of the relevant hosting provider. Renewal of domains and hosting is your responsibility unless a managed plan is agreed.
  • We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance or take the site offline for emergency fixes.
  • Clients are responsible for maintaining backups of their content unless a managed backup service is purchased.

9. Disclaimer and limitation of liability

Our website and services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied. We will not be liable for any indirect, incidental, special or consequential damages, including loss of profits, data or business opportunities, arising from your use of our website or services, or from the performance or non-performance of the services.

Our total liability for any claim arising out of these Terms or your use of our services will be limited to the amount you paid to us for the specific service giving rise to the claim, or the statutory minimum permitted by law, whichever is lower.

Our website may contain links to third-party sites and services. We are not responsible for the content, availability, or practices of those third parties, and their terms and privacy policies apply.

11. Termination

We may suspend or terminate access to our website or services if you breach these Terms, if required by law, or for operational reasons. On termination, Sections relating to intellectual property, disclaimers, limitation of liability and governing law will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of the United Republic of Tanzania (including Zanzibar). Any dispute arising out of or in connection with these Terms will be subject to the jurisdiction of the competent courts of Tanzania, unless otherwise required by applicable law. Nothing in these Terms limits your statutory rights as a consumer under applicable law.

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
